Illness during parental leave

When your child gets ill

When your child gets ill during parental leave, you may be entitled to attendance allowance and postponement of parental leave. The way The National Insurance Act (NIA) § 14-11 first section letter d (lovdata.no) (Norwegian) is expressed, there is an absolutely demand that the child is hospitalized for one to postpone the parental benefit due to the child's sickness. The National Insurance Act (NIA) § 9 distinguishes between attendance allowance and graded attendance allowance:

a) Claim for attendance allowance pursuant to NIA Section 9-10

• Event: Your child is/has been an inpatient at a healthcare institution or is being treated as a hospital outpatient or needs continuous monitoring and care. cf. National Insurance Act Section 9-10 (lovdata.no) (Norwegian).
• Requirements: One of these requirements must be fulfilled:
  • You must stay with the child while he or she is an inpatient at a healthcare institution.
  • You must stay at home with the child because he or she needs constant care and supervision.
• Your entitlements:
  • You are entitled to full pay during the period you receive attendance allowance up to 1300 days of benefit.
  • Attendance allowances may be paid over a period of up to 10 years per child.
  • Pursuant to the National Insurance Act, Section 9-10 (lovdata.no) (Norwegian) attendance allowance can be granted to both parents simultaneously. Two caregivers may also split an attendance allowance up to 100 percent as long as both has a minimum of 20 percent. For instance 60/40, 20/80, 50/50.
• What you must do:
  • Fill out and sign the form medical declaration for a claim for attendance allowance when a child is ill NAV 09-11.05 (nav.no) (Norwegian) with a medical statement made by a hospital physician.
  • Submit «Arbeidsgivers eksemplar» of this form to the parental leave team (e-mail) so that UiO can file a claim for reimbursement with NAV.
  • Apply for postponement of parental benefit (nav.no) (online in Norwegian) or application for flexible drawing of benefit NAV 14-16.05 (nav.no) (hard copy in English) for the period in which you receive attendance allowance for the same child. Attach the confirmation of admission from the health institution.
  • Submit a copy of the NAV decision to the parental leave team (e-mail). Remove any health information.

b) Claim for graded attendance allowance pursuant to NIA Section 9-11

• Event: Your child is in need of continuous monitoring and care, but there has been establish another supervision or relief arrangement for your child , cf. the National Insurance Act Section 9-11 (lovdata.no) (Norwegian).
• Requirements:
  1. The child is under the care of third parties less than 80 percent.
  2. Graded attendance allowance cannot be less than 20 percent.
• Your entitlements:
  • You are entitled to full pay during the period in which you receive attendance allowance up to 1300 days of benefit.
  • Attendance allowance is granted from the first day.
  • The percentage of the graded attendance allowance will be deducted from the total amount of days with benefit. Attendance allowances may be paid over a period of up to 10 years per child.
  • Pursuant to the National Insurance Act Section 9-11 (lovdata.no) (Norwegian) attendance allowance can be granted to both parents simultaneously if needed.
• What you must do:
  • Fill out and sign the form medical declaration for a claim for attendance allowance when a child is ill NAV 09-11.05 (nav.no) (Norwegian) with a medical statement made by a hospital physician.

When you get ill

When you get ill, you may be entitled to postponement or transfer of parental leave:

• Event: You have a medical certificate from your doctor and are unable to take care of your child. Short-term illnesses such as influenza and the like do not entitle you to transfer parental leave.
• Requirements: Both these requirements must be fulfilled:
  1. You have a medical certificate for sick leave from your doctor.
  2. Due to illness or injury you are completely dependent on help with taking care of your child.
• What you must do:
  • Request a function description from your doctor. The function description should clearly explain «why the illness makes you completely dependent on help to take care of the child» and describe specifically:
    1. why the illness/injury affects your ability to take care of the child
    2. the degree to which you as the benefit recipient rely on help
    3. estimated duration of the illness.
  • Apply for postponement of parental benefit (nav.no) (online in Norwegian) or application for postponement of benefit NAV 14-16.05 (nav.no) (hard copy in English) for the period in which you are on sick leave. Alternatively you may apply to have your parental leave transferred to your partner.
  • Send the following documents to the parental leave team (e-mail):
    • Copy of your postponement of parental benefit (nav.no) (online in Norwegian) or application for postponement of benefit NAV 14-16.05 (nav.no) (hard copy in English); remove any health information.
    • Part D of the medical certificate if you have received it on paper; in case of digital sick leave, you must provide a separate notice to the parental leave team that it has been delivered digitally to the employer.
