You are expected to write TWO essays (each counting 40% towards your final grade) and to answer TWO short questions (each counting 10%), so the exam is slightly different from last time around (Fall term 2004). Then it was like this:

PART I: ANSWER BRIEFLY AND CONCISELY FOUR OF THE FOLLOWING FIVE QUESTIONS (20% OF TOTAL GRADE):

1. What is the burden of proof in a civil case and in a criminal case respectively? 2. What is the function of a Grand Jury? 3. Which standard of scrutiny is used by the courts in cases involving fundamental interests? 4. When the above standard (Question 3) is used, what criteria must be met in order to satisfy this standard? 5. What is meant by the term bail in a legal context?

PART II: ANSWER ONE OF THE FOLLOWING QUESTIONS (80% OF TOTAL GRADE):

EITHER

1.Federal judges are appointed for life (“during good behavior”), whereas most state judges are elected for limited terms. Discuss the advantages and disadvantages of the two systems, using examples to illustrate your points.

OR 2.“The United States is not only a legalistic society, it is a litigious one as well.” Discuss this statement, pointing out positive and negative aspects of the emphasis on law and written documents in American society.

OR

3.Describe the progress of an ordinary criminal case, from the arrest of the suspect until a verdict has been issued by the trial court. Identify the various stages of the case, the personnel and institutions/functions involved, including the proceedings of the trial court.
